Many factors contribute to a fatal traffic accident. These include alcohol, weather, road conditions, maintenance or structural issues, driver fatigue, and, in the case of commercial truck drivers, lack of proper training.

Negligence on the road takes many forms:

  • Distracted driving, such as texting, using social media, talking on the phone or taking photos or videos while driving;
  • Driving under the influence of drugs or alcohol, including marijuana, sleep medications and prescription, or over the counter medications that may affect driving;

The investigating officer will examine the scene, take statements from the persons involved and witnesses, if any, and form a conclusion as to fault for the collision. This information, together with photographs and videos (including officer body-cam footage) and the testimony of the parties can then be evaluated by accident reconstruction and biomechanical experts.

In cases involving an accident with a commercial or company vehicle, the responsibility can lie with or be shared by someone other than the driver, such as the company or individual that owns, schedules, loads, maintains or repairs the commercial vehicle. In Texas, there are generally two kinds of causes of action that can be brought when a person dies as a result of negligence. One is a wrongful death claim, which is brought by the spouse, parent, or child of the deceased. Typical actual damages in a wrongful death claim include loss of consortium, loss of services, and loss of companionship and society.

It is named this way because it is a claim that belongs to the deceased and “survives” their death. In other words, the estate of the deceased itself, through a proper representative, sues for compensation for damage elements such as the medical expenses, physical pain, physical impairment and mental anguish that the deceased suffered as a result of the negligence but before death. The estate may also sue for funeral expenses.
