Specifically, you must have taken and finished an approved motorcycle operator safety course, and you must be able to prove you have at least $10,000 worth of health insurance coverage.

While you are able to file a personal injury claim if you were not wearing a helmet at the time of the accident, that fact can affect the amount of compensation you may ultimately be awarded.

Not wearing a helmet can affect your damage award depending on the types of injuries sustained in the accident. For instance, if you broke a leg, it is tough to argue that wearing a helmet would have minimized your injury. However, if you sustained a traumatic brain injury or other head or neck injuries, the other party is likely to argue that your lack of wearing a helmet caused more severe injuries than if you had worn a helmet.

Additionally, Texas follows the comparative fault doctrine. The law recognizes that a crash may not be the total fault of one person and adjusts financial recovery according to the percentage of fault. If you are found to be zero percent at fault, you can recover the full amount of damages awarded. If you are partially to blame, the damages are reduced by the percentage of negligence attributed to you. This means if you were 35 percent to blame for the crash, you could still recover 65 percent of the damages. If you are found to have contributed more than 50 percent to the accident, then you will not be awarded damages.
