First-Degree Burns

First Degree Burns

A first-degree burn affects only the epidermis, the outermost layer of the skin. A first-degree burn often causes minor pain and redness but does not usually cause blisters or open sores. first-degree burns typically heal within a week. For example, a bad sunburn may be considered a first-degree burn. Treatment for a first-degree burn includes soaking the burnt area in cool water and the use of over-the-counter pain medication.

Second-degree burns affect the epidermis as well as the dermis, the second layer of skin. Second-degree burns cause pain, redness, and blistering. While some second-degree burns can be treated with antibiotic ointment and a sterile bandage, many require a skin graft. A skin graft is a medical procedure where a doctor places artificial skin or a section of healthy skin over the burnt area to protect it as it heals. Most second-degree burns result in permanent scarring.

Third-degree burns are the most severe type of burn, affecting all three layers of the skin. In some cases, these burns will also cause damage to the underlying nerve endings, sweat glands, and hair follicles. While third-degree burns are excruciating, if the burn damages the nerves, there may be little to no pain initially. Third-degree burns will often result in severe scarring and may require multiple skin grafts.

Additionally, the deceased victim's estate can bring a survival action for the pain and anguish that the deceased accident victim suffered leading up to their death and their medical and funeral expenses.

Loss of inheritance is defined as the present value that the victim would, in reasonable probability, have added to the estate and left at natural death to the statutory beneficiaries, but for the wrongful conduct that resulted in the death.

In some cases, a judge or jury can award exemplary (punitive) damages. Unlike actual damages, punitive damages are not designed to compensate the plaintiff for their injuries. Instead, punitive damages focus on punishing the defendant for their especially egregious behavior.
